New guidance: Outsourcing (BPO) and Shared Services

Gorrissen Federspiel has published new Best Practice Guidance on outsourcing (BPO – Business Process Outsourcing) and Shared Service Centres, outlining key legal and commercial considerations in a market shaped by rising costs, geopolitical uncertainty and rapid developments in AI.

The guidance highlights common processes companies may outsource – including finance, HR, procurement, administrative functions and support services – and explains the differences between captive shared services, traditional BPO models, and BOT/BOTT structures.

Based on market developments over the past decade, the guidance notes that the business case for BPO has in many cases strengthened and that both existing and new outsourcing initiatives should be structured around resilient contract terms and realistic expectations regarding AI-driven transformation.
